CONDITIONS OF PARTICIPATION in events organized by ATUH SINDBAD

  1. Signing contract.
    1. Hereby conditions of participation regard contracts with Agencja Turystyczno-Usługowo- Handlowa SINDBAD Leszek Janas, 42-700 Lubliniec, ul. Karola Miarki 6a called the Organizer, for touristic services except air flights. Touristic services offered by the Organizer are a touristic package published on www.travelinfo.pl, except air flight tickets. Air flight tickets should be booked individually on www.wizzair.com
    2. Hereby conditions of participation are the general conditions of the Organizer, used in contracts on touristic services.
    3. Signing the contract with the organizer the Customer confirms the acceptance of the hereby conditions of participation, which are the integral part of the contract.
    4. The contract comes into force from the moment of signing by the Customer and the Organizer, or by another travel agency, called the Agent, authorized by the organizer, with simultaneous transfer of pre-payment or the whole amount for the event by the Customer.
    5. The customer signs the contract on behalf of oneself and the third person, whose data is in the contract as the data of event's participants.
  2. Conditions of payment.
    1. When signing the contract the Customer is obliged to pay the whole cost of the price stated in the contract.
    2. The payment should be done with a credit card or by a bank transfer on the Organizer's account. ATUH SINDBAD do not accept cash.
    3. When using the bank transfer the reservation will be valid for 5 week days. The money should be transfered within this period.
    4. The contract is dissolved and the people's names are taken off the list of participants if the payment is not completed in the above term.
    5. The Customer receives a voucher, a document confirming the services, to a given e-mail address, after the whole amount for the event is paid.
    6. An invoice will be mailed to you after the payment.
    7. No money will be paid back to the Customer who resigns from whatever service.
  3. Change of prices and scope of services.
    1. The Organizer has the right to change the programme and scope of services of an event, if the change is caused by reasons beyond the Organizer's control, and the contract services can only be replaced by services of the same or higher standard and in the same number, in the above mentioned case the Customer has no right to any financial claim.
    2. If the change of the programme or scope of services reduces the level of contract services or the number of the services, the Organizer is obliged to inform the Customer about the change. In such case the Customer has the right to renounce of the contract and keeps the right to recover the payment. If the Customer does not counter a written motion within 3 days, the Organizer will acknowledge that the Customer has agreed to it, and the decisive is the date the Organizer receives the written motion.
    3. The Organizer has the right to increase the price of the event, but not later than 30 days before the beginning of the event. The increase of prices can be particularly motivated by the change of currency exchange and prices that can influence the cost of the event.
    4. More than 15% increase of the event's price allows the Customer to dissolve the contract. To dissolve the contract the Customer has to inform the Organizer about it within 5 days from the day he has been informed about the increase of the price, but the contract cannot be dissolved later than 14 days before the beginning of the event. In the case when the above terms are not met or the prices do not increase over 15% the Customer is obliged to pay the additional amount within 7 days before the beginning of the event, if not appropriate decisions of point II item 4 will be put inot force.
  4. Calling off an event.
    1. The Organizer has the right to call off an event, 14 days before its beginning, through the Organizers fault or in case of unappropriate number of participants.
    2. An event can be called of at any time because of circumstances outside the Organizer's control.
    3. Calling off an event obliges the Organizer to prepare another offer to the Customer or recover the payment.
    4. On the basis of point IV items 1,2,3, the Customer does not have the right for compensation, only for the recover of the payment.
  5. Resignation from the participation in the event.
    1. Resignation from the participation in the event is valid from the date the Organizer receives the letter with Customer's declaration of resignation.
    2. The Organizer has the right to a deduction from the Customer's payment according to the below rules:
      1. 50PLN per person - administrative costs, if the resignation takes place 45 days before the event.
      2. 10% event's value, if the resignation takes place 45 days before the event.
      3. 30% event's value, if the resignation takes place 44 to 31 days before the event.
      4. 50% event's value, if the resignation takes place 21 to 15 days before the event.
      5. 70% event's value, if the resignation takes place 14 to 8 days before the event.
      6. 90% event's value, if the resignation takes later than 8 days before the event.
    3. If the Customer dissolves the contract and points other possible participant in the event, the Organizer has the right to take the additional administrative costs amount - 50 PLN per person.
    4. If the Customer dissolves the contract during the event because of circumstances outside the Customer's control, the Organizer has the right to the price for already delivered services and the services which will be delivered despite the renouncement of the contract. If the Customer resigns for some other reasons the Organizer keeps the whole payment.
    5. If The Customer does not come to the meeting on the day of departure and makes the departure impossible because of customs, and also in the case of individual arrival at the hotel - not appearing at the hotel by the end of the first day of service, the contract is dissolved.
    6. The Organizer's deduction is a compensation defined in point 396 K.C.
  6. Insurance.
    1. The Customer is obliged to get personally a sickness insurance and an accident insurance, unless the offer has a different option. The Organizer advices the Customer to sign a luggage insurance contract and a resignation costs insurance contract.
  7. Complaints.
    1. If the contract is not fulfilled or not completely fulfilled by the Organizer, The Customer has the right to lodge a complaint, but not later than within 7 days from the end of the event.
    2. The complaint should have a written form and should contain a reason and the proposal of making up the loss.
    3. The complaint should be sent to e-mail: info@travelinfo.pl, or fax +48 34/35 100 10.
    4. The complaint shall be examined by the Organizer within 14 days from the receipt of the complaint.
    5. The complaint cannot be caused by circumstances beyond the Organizers control.
  8. The scope of the Organizer's responsibility.
    1. The Organizer is responsible for the suitable realization of the touristic event. Within this scope the Organizer is responsible only for the actual loss the participant incurs.
    2. The Organizer does not take the responsibility for violation of the contract connected with its fulfilment, if it was caused by the Customer or third person who is not in legal relation with the Organizer.
    3. The Organizer does not take the responsibility for the renouncement of the contract caused by the stop of the Customer by boarder officers or lack of valid documents authorizing the Customer to go abroad.
  9. Final regulations.
    1. In cases beyond the control of the above conditions use: Law of 29th August 1997 on Touristic Services and the Civil Code.
    2. All disputes resulting from the contract's complaint are judged by the court of justice appropriate for the Organizer.
